48v 200ah lifepo4 with 200a BMS can be used with a Powmr 12kw? Or do I have to get the 8Kw? Will there be a problem oversizing?

I'm looking at 12KW 48V 220/380V Three Phase Hybrid Inverter
or SunSmart 8KW 48V 220/380V Three Phase 2 MPPT Hybrid Inverter

My battery pack is 16 cells of 3.2v 200ah, with a daly BMS 48v 200a

My question is about the inverter... can a 12kw converter be used with a battery that can only deliver 10kw... maybe for future expansion...

Converter or inverter?

Yes, you can use it. You will just be limited to 200A output from the battery - whatever is attached.
 
If you exceed the BMS limits for very long, your battery will shut down, and your inverter will not produce any power. If you are well under the output power of your battery (and the conversion efficiency of your inverter), then you should be fine.
