Since the CEO of Sol-Ark has personally come on the forum and categorically stated in writing that the IP belongs to Sol-Ark and that they let Deye use the IP in the Asian Market, I am going to go with that one until someone in management at DEYE disputes that claim. Deye having three agents in the USA means nothing as they have a wide range of other products that might fall under their own IP.I hate to say this about anyone but this just sounds like they are just attempting a scare tactic to protect their bottom line. And if they did do it, there would be potential legal repercussions regardless of IP issues IMHO. Especially if they did it without notice or warning OR without clearly stating they did it with legally backed reasons as to why, they will be in a world of problems. In this case, the user of X product didn't sign any such exclusivity agreement with regards to where they can use the product they purchased.
Furthermore, they are NOT exclusive in the USA. They are one of the 3 agents that Deye has in the US. This is coming from Deye directly, it's not hearsay.
I have not seen a Deye fail yet (of installations I know of).....
I am not quiet sure why people have a hard time believing that Sol-Ark owns the IP? This tactic is something that the Chinese do over and over to other US companies. The products end up over on Amazon, Alliexpress and eBay. You see an Item from an American company that has several knock of versions coming out of China, all of them for half the price and are of very low build quality and Zero warranty.
Most companies have to make their products in China and it's pretty hard to stop a communist regime from breaking agreements.
BTW this might not be just a scare tactic from Sol-Ark. They definitely seem to be the ones in complete control of the firmware for the unit. As for legal issues, if the CEO of Sol-Ark is telling the truth then they own the IP and would have a legal right to shutdown copies that are sold illegally. I get riled by this crap not because of Sol-Ark but because I have had my own IP stolen and used in the same way by a Chinese manufacturer.
